6. To use the Store, the Customer must have a data communications device with internet access, a correctly configured web browser in its current or previous version: Microsoft Edge, Mozilla Firefox, Google Chrome, Safari or Opera, with JavaScript enabled, and an active and correctly configured email account.

§2. Account registration

1. The contract for the provision of the Customer Account Service is concluded for an indefinite period at the moment the Seller confirms registration of the Customer Account.

2. The subject of this Customer Account Service is providing access to the Customer Account panel, which enables, among other things, the management of Customer data and orders.

3. To create a Customer Account, the Customer must complete a voluntary and free registration. This is done by completing a registration form and sending it to the Seller; the form is available on the Store website.

4. For the registration form to be correctly completed, all its mandatory fields and any optional fields must be filled in with true and complete data or information concerning the Customer.

5. Before sending the registration form, the Customer should declare, by ticking the relevant box, that they have read the Terms and Conditions and accept their provisions.

6. The registration form is sent to the Seller using the Store’s features and through the Store.

7. The Customer Account can be used once it has been created and the Customer has logged in using the correct login and password.

8. It is prohibited to share Customer Account access details with third parties and for one Customer to set up several Customer Accounts.

10. The Seller may terminate the contract for the provision of the Customer Account Service without giving a reason and at any time, with a notice period of 14 days and without prejudice to the rights acquired by the Customer before termination of the contract.

This feature makes it possible to search the Store’s resources using keywords entered by the Customer. In addition, the feature may enable an advanced search using selected criteria.

6. Using some of the features listed may require having a Customer Account and logging in to it.

§4. Orders placed through the Store

•  choose a payment method and delivery method.

5. Before placing an order, the Customer receives, by way of display in the Cart area, information on the total price of the order including taxes and related costs, in particular delivery and payment costs.

6. An order can be placed by using the appropriate button in the Cart, which is equivalent to the Customer submitting to the Seller an offer to conclude a contract of Sale for the Goods included in the order.

7. Before sending the order form, the Customer should declare, by ticking the relevant checkbox, that they have read the Terms and Conditions and accept their provisions.

8. Acceptance of the Customer’s offer by the Seller subject to the change referred to in the preceding point is deemed to be a new offer, which must be accepted by the Customer in order for a contract of Sale to be concluded.

9. The Seller confirms acceptance of an order by sending an email without delay. This message contains the terms of the contract of Sale agreed by the parties and the data entered by the Customer in the order form, so that any errors in them can be detected. If such an error is detected, the Customer may notify the Seller by sending an email stating the correct data.

10. Confirmation of acceptance of the order is equivalent to acceptance by the Seller of the offer to conclude a contract of Sale submitted by the Customer.

§5. Sale

1. The Seller provides Customers with the Service of the distance Sale of Goods.

2. The Goods available in the Store are in each case presented in the current range on the Store website. The specific features of each item of Goods, its composition and its characteristics can be found in the descriptions of the Goods in the Store.

3. The subject of a contract of Sale comprises the Seller’s obligation to transfer ownership of the Goods to the Customer and to hand them over, and the Customer’s obligation to collect the Goods and pay the Seller the price of the Goods.

4. The Seller reserves the right to run promotional campaigns, consisting in particular of reducing the price of Goods or Services until a specified date or until stocks of the Goods on promotion run out.

5. By concluding a contract of Sale, the Seller undertakes to deliver Goods to the Customer free from defects.

4. The time for delivering Goods to the Customer is 10 working days, unless a shorter period is stated in the description of the Goods or during the ordering process.

5. With advance payment, the period for dispatching the Goods is counted from the date the payment is credited to the Seller’s bank account.

6. With any payment option, the Goods are handed over no earlier than after payment has been made by the Customer.

7. Confirmation that the Goods have been handed over to the Carrier for delivery may be made by sending an email to the Customer’s email address.

8. The risk of accidental loss of or damage to the item passes to the Consumer when it is handed over to the Consumer.

9. If the Customer chooses delivery by a Carrier, it is recommended that the Customer examines the delivered parcel in the presence of the Carrier.

10. If damage to the parcel is found, we recommend making a complaint directly to the Carrier – preferably by drawing up a report on the condition of the parcel with the Carrier – or contacting the Seller. For delivery by Parcel Locker, we recommend showing the damage to the Parcel Locker’s monitoring camera, placing the damaged, unopened parcel in the same Parcel Locker compartment in which it was located and closing that compartment, in accordance with the messages on the Parcel Locker screen. A complaint should then be made to the owner of the Parcel Locker, in accordance with the messages on the Parcel Locker screen, or to the Seller.

§8. Payments

1. The amount payable for the Sale is determined on the basis of the price list for the Goods on the Seller’s website at the time the Goods are ordered.

2. Prices stated on the Store website for a given item of Goods are gross prices in Polish zloty and include applicable taxes, but do not include the cost of delivering the Goods or of the chosen form of payment.

3. The Customer bears the transaction costs and the cost of delivering the Goods.

• withdrawal from the contract by the Consumer,

• recognition by the Seller, in whole or in part, of a claim covered by a complaint, on the basis of generally applicable provisions.

9. Payments are refunded using the same payment method as the Customer used in the original transaction, unless the Customer agrees to another solution that does not involve any costs for them.

2. A complaint may be submitted by letter or email to the Seller’s postal or email address. It may be submitted using the form provided as a template in the appendix to the Terms and Conditions, but this is not mandatory.

3. It is recommended that the complaint includes:

• the Consumer’s contact details, which will be used to reply to the complaint and for related correspondence,

• the Consumer’s bank account number, which will be used to refund money, should this arise,

• a description of the problem and the Consumer’s identification details.

4. Where the complaint concerns Goods that are a physical item, in order for the Seller to consider the complaint, the Consumer is required to deliver or send the Goods complained of to the Seller’s address, at the Seller’s expense.

5. The Seller considers complaints within 14 days of the date on which they are submitted.

6. The Seller will inform the Consumer of how the complaint has been resolved electronically or by ordinary letter, depending on the Consumer’s wishes or the method used to submit the complaint.
